Two federal announcements landed on August 12, 2026 and Andrew Arthur of the Center for Immigration Studies read both as proof that fraudsters now treat American institutions as merchandise.
Arthur, the resident fellow in law and policy at CIS, opened his analysis bluntly. "For those of us who believe in the sanctity of certain institutions— like matrimony and children—August 12 was a dark day."
The first item came from the Justice Department, which unsealed charges against 11 people in a "decade-long nationwide marriage fraud scheme" built on "more than 1,000 sham marriages." Prosecutors say the network served mostly Chinese nationals, some paying up to $100,000 apiece. Attorney General Todd Blanche called it one of the largest marriage fraud prosecutions in the country's history. Every defendant remains presumed innocent.
Arthur, who worked for the former INS in California during the 1990s, notes the price has soared since aliens bought quick green cards for a fraction of six figures. He ranks marriage fraud among the oldest immigration schemes going, possibly the original one.
Congress swung at it forty years ago. The 1986 amendments on marriage fraud imposed a two-year conditional residence period on alien spouses and stiffened section 275 of the Immigration and Nationality Act, which now warns that anyone who "knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000, or both." Arthur points out that the 1986 fine would top $750,000 today.
Deterrence failed anyway. The Government Accountability Office reported that "Potential marriage fraud was consistently the most common subject of" the USCIS fraud directorate's "benefit fraud investigations."
The second announcement concerned children. Six days after Trump signed Executive Order 14419, which orders State and DHS to block exploitation of visa categories by persons "engaging in birth tourism," the State Department unveiled its Birth Tourism Prevention Task Force. State reports more than 600 visas already revoked and describes a "pervasive" trade whose operators "sometimes market themselves as doulas, midwives, or wellness advocates while openly advertising 'birth in the U.S.' services, visa coaching, and hospital arrangements."

It’s ultimately the logic of mass migration distilled into one transaction, where citizenship becomes a product sold to whoever affords the airfare. Half measures invite exactly this. America needs deep, permanent cuts to legal admissions alongside relentless enforcement against illegal entry, because a nation that will not guard the meaning of its citizenship will not keep it.
