Millions of potential visa overstay cases received little follow up during the Biden administration, including thousands tagged as possible national security or public safety concerns, according to a new DHS watchdog review. The findings, first highlighted by Breitbart, point to a major enforcement weakness beyond the southern border.
The DHS Inspector General reported that ICE received 3,145,375 leads about possible nonimmigrant overstays between fiscal years 2021 and 2024. Of those, 104,049 were flagged as possible national security or public safety cases. ICE opened 496 investigations within that group and made eight arrests resulting from those lead-based inquiries.
A lead does not establish that an individual has committed a crime or poses a verified security threat. Still, the review shows that ICE collected a substantial number of potential overstay referrals while initiating only a limited number of cases through the lead-based enforcement process reviewed by the watchdog. The report does not measure arrests that may have resulted from unrelated ICE operations.
The inspector general linked the low rate of follow up partly to a September 2021 ICE policy. Under that approach, Homeland Security Investigations focused on Priority 1 leads that appeared to involve threats to national security, public safety, or border security. Yet ICE initiated only 84 investigations from 1,769 viable Priority 1 cases and made two arrests.
The report concluded, “ICE conducted few nonimmigrant overstay lead initiated investigations and arrested even fewer foreign nationals who stayed beyond or violated the terms of their admission because of the September 2021 policy that directed ICE’s limited resources only to leads posing a threat to national security, public safety, and border security.” It also cited incomplete address information, the difficulty of locating individuals, and insufficient resources as barriers to enforcement.
The federal government’s most recent overstay data found 482,954 suspected in country overstays at the end of fiscal year 2024. The report identified 538,548 overstay events during that year, equal to 1.15 percent of expected departures tracked by DHS.
DHS Secretary Markwayne Mullin condemned the Biden administration after publication of the watchdog findings. “The degree of the Biden administration’s dereliction of duty, which needlessly put American lives at risk, is staggering and enraging,” Mullin said.
Mullin also said, “Unlike the Biden administration, the Trump administration will always put the safety of the American people first. We will target and remove as many illegal aliens as possible to make America safe again.”
Visa overstays represent a major channel for illegal immigration and demand the same sustained attention as unlawful border crossings. A serious approach to this question would strengthen entry and exit tracking, require timely investigation of credible leads, and ensure that people who violate the conditions of admission cannot simply disappear into American communities.
